ARCADIA WATERSPORTS — RENTAL AGREEMENT, RELEASE OF LIABILITY & ASSUMPTION OF RISK
This Agreement is entered into between Arcadia Watersports ("Company") and the undersigned renter ("Renter"). By signing, Renter agrees to the terms below for the rental of the selected watercraft and related equipment.
1. Assumption of Risk
Renter understands that operating boats and personal watercraft involves inherent risks, including but not limited to collision, capsizing, drowning, mechanical failure, weather, and the conduct of other watercraft. Renter knowingly and voluntarily assumes all such risks.
2. Operator Requirements
Renter affirms the operator is at least 21 years of age, holds a valid and unexpired government-issued driver's license, and will not operate the watercraft while impaired by alcohol or any substance (operating a vessel under the influence is illegal in Oklahoma). Only the named renter and approved operators age 21 or older may operate the watercraft. Renter understands that under Oklahoma law every child age 13 or under must wear a U.S. Coast Guard–approved life jacket at all times while underway on a vessel under 26 feet, and that anyone aboard a personal watercraft (jet ski) or being towed must wear one regardless of age. A Coast Guard–approved life jacket will be provided for every person aboard.
3. Responsible Use & Damage
Renter agrees to operate the watercraft safely, within posted areas, and to return it in the condition received aside from normal wear. Renter is fully responsible for any and all loss or damage to the watercraft and equipment during the rental period, including damage beyond any insurance deductible, and accepts full financial liability for all such damage regardless of the coverage selected. Renter authorizes the Company to charge the payment method on file for fuel used during the rental, billed after the watercraft is returned.
4. Release of Liability
To the fullest extent permitted by law, Renter releases and holds harmless the Company, its owners, and staff from any claims, injuries, or damages arising from the rental, except those caused by the Company's gross negligence or willful misconduct.
5. Weather & Cancellation
The Company may delay or cancel any rental for unsafe conditions. Renter cancellations made at least 24 hours in advance receive a full refund.
By signing below, Renter acknowledges they have read, understood, and agree to be bound by this Agreement.
